1. About These Terms

These Terms & Conditions ("Terms") govern your access to and use of the website located at phoenixinsights.gr (the "Site") operated by Olga Tsatsani trading as Phoenix Insights (sole trader), a company registered in Greece (VAT: 145572234; GEMI: 188391603000).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

2. Description of Services

Phoenix Insights provides UX research and cognitive neuroscience consulting services to business clients. The Site is a marketing and informational platform. Services available include, but are not limited to:

• UX Research & Audits — identification of attention failures, trust breaks, and conversion drop-offs through structured research methodologies, competitive analysis, and behavioural audits
• Neuro-Research & EEG Lab — lab-grade neurological validation using EEG and eye-tracking to measure cognitive load, attention, and emotional response in response to digital products, brands, and advertising

The specific scope, deliverables, fees, timelines, and contractual conditions for any engagement are agreed separately in a written service agreement or statement of work ("SOW") between Phoenix Insights and the client. These Terms do not constitute a service agreement and do not create any obligation to provide services.

3. Intellectual Property

3.1 Ownership

All content on this Site — including but not limited to text, graphics, images, 3D visualisations, animations, methodological frameworks, scoring models, and proprietary terminology — is the intellectual property of Olga Tsatsani trading as Phoenix Insights, or is used under licence, and is protected by Greek and European intellectual property law.

3.2 Proprietary Frameworks & Instruments

The following are proprietary to Phoenix Insights:

• The Phoenix Framework™ — a four-stage research methodology (Frame, Measure, Translate, Apply)
• UX Benchmark Model — an eight-dimensional UX evaluation instrument
• NCES (Neurocognitive Engagement Score) — a composite metric for measuring neurological engagement

These names, methodologies, and scoring systems may not be reproduced, repackaged, sublicensed, or passed off as a third party's work without prior written consent.

3.3 Permitted Use

You may view and print pages from this Site for your own internal business evaluation purposes only. You may not reproduce, distribute, modify, transmit, repost, or otherwise use any content from this Site for public or commercial purposes without our express written consent.

3.4 Deliverables from Engagements

Ownership of reports, presentations, and other deliverables produced under a client engagement is governed by the applicable SOW. Unless otherwise agreed in writing, Phoenix Insights retains ownership of underlying methodologies, frameworks, and tools; the client receives a licence to use the specific deliverables for their internal purposes.

4. Confidentiality

Any information you share with us via the contact form or during pre-engagement discussions will be treated as confidential and used only for the purpose of evaluating and delivering our services. Phoenix Insights will not disclose client information to third parties except as required by law or as necessary to deliver the agreed services (e.g., engaging specialist subcontractors under appropriate confidentiality obligations).

Detailed confidentiality obligations for client engagements are set out in the applicable SOW or non-disclosure agreement ("NDA").

5. Disclaimers & Limitation of Liability

5.1 Website Accuracy

The information on this Site is provided for general informational purposes. Whilst we take care to keep it accurate and up to date, we make no warranties — express or implied — regarding the completeness, accuracy, fitness for purpose, or availability of the Site or its content.

5.2 Research Outputs

Research findings, recommendations, and scores delivered as part of an engagement represent our professional assessment based on the data collected and the agreed scope. They do not constitute a guarantee of any specific business outcome. Business decisions made by the client based on Phoenix Insights' deliverables remain the sole responsibility of the client.

5.3 Limitation of Liability

To the fullest extent permitted by applicable law, Phoenix Insights shall not be liable for any indirect, incidental, consequential, or special loss or damage arising from your use of this Site or from any engagement, including but not limited to: loss of revenue, loss of data, loss of goodwill, or business interruption.

Our total aggregate liability for any claim arising out of or in connection with an engagement shall not exceed the fees paid by the client for the specific engagement giving rise to the claim, unless otherwise agreed in the applicable SOW.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded under applicable Greek law.

5.4 Third-Party Links

This Site may contain links to third-party websites. These links are provided for convenience only. Phoenix Insights has no control over, and accepts no responsibility for, the content, privacy practices, or availability of any linked site. Inclusion of a link does not imply endorsement.

6. Website Availability

We do not warrant that this Site will be continuously available, error-free, or free from viruses or other harmful components. We reserve the right to suspend, withdraw, or modify the Site at any time without notice and without liability.

The parties irrevocably agree to the exclusive jurisdiction of the competent courts of Athens, Greece, to settle any dispute or claim arising out of or in connection with these Terms or their subject matter, save that Phoenix Insights reserves the right to seek injunctive or other equitable relief in any jurisdiction where necessary to protect its intellectual property.
